I am currently in the process of getting a divorce and have a jointchecking account with my spouse. We have established another account solely in his name to cover finances for the home we currently both own, and in which he lives. I have asked him several times since the separation to remove his name from the joint checking account, but he refuses to do so. He has been very irresponsible in his spending, spiralling the account in a negative balance every two weeks. I am in the military and my direct deposit is sent to this account every two weeks, and eventually becomes depleted and overdrawn within a matter of days. What is my recourse at this point, legal or otherwise, to remove him from the account?

Most banks will not remove a name from an account. Instead they want the account closed and a new account opened.
If a name is removed from a checking account, what is the bank to do when a check comes in signed by the other person, what if that check was dated before they were removed? These are difficult questions and would require special handling. It is simply cleaner to close and open a new account. In your case that means redirecting your deposits and possibly automatic withdrawals, but there is no easy way around this to achieve the results you want.
