Can a bank legally force payment of overdraft charges on an account they closed, while delaying a land payment which would have prevented the overdrafts? They dragged their feet in signing off on a check as a mortgage holder until $2000 in overdrafts had been added. The account would not have been overdrawn if the check had been released as instructed. It was delayed from January to August. Only with legal action, were they were forced to release the check.

It sounds like there is a lot more to this than what is here. If payment was delayed on a check by eight months, this was no oversight.
If the bank was deemed wrong in holding the check, they may have some liability. At the same time, checks shouldn't be written until the funds to cover them are in the account.
