Under the version of the UTMA law in effect in most states, there is no requirement that the adult who serves as custodian on the account (which is the person who has the authority to do transactions on behalf of the child) even be a family member. Obviously, the most common situation is for the person setting up the account to be a parent, but that's not a legal necessity. Whoever sets it up, however, will need to have the child's Social Security number.
