Joint Account Deposit: Is Signature Required?

I have a joint account with my husband. He has been taking checks that are made out to only me, writing on the back of the check "for deposit only" and depositing them into our joint account, Is this legal? Is the bank allowed to accept and deposit these funds without me signing the back of the check?

The short answer is, yes; the bank usually can accept checks for deposit without the payee's endorsement. Banks prefer to get their customers' endorsements, and may even require that customers endorse checks for deposit when the customer is present, but there are often times when a payee doesn't bring a check in for deposit. Unless the check states that a personal endorsement is required (that is sometimes the case with checks from insurance companies), the bank can accept the check for deposit to an account of the payee, included a joint account with another individual.
