Obtaining Money without going to Probate

My dad died two weeks ago and he had no will or assets except for a $6000 bank account. Is there any way I can get this money without going to probate?


Contact the bank. Many states have laws that permit banks to pay out a decedent's accounts to a next of kin or a funeral home if the account balance is relatively low. The bank will know whether such a law applies, and what the maximum account size is.

You'll need a certified copy of your father's death certificate, and some form of documentation of your kinship (your birth certificate should show your father's name, for example). If your father left other family, the law may require that they sign off on your request.
