Pockets Empty because of ATM Error

I deposited a check to my bank via ATM. The check cleared and I saw the amount in my online banking display. Few days later, the bank deducted the same amount, indicating "ATM ERROR". I called the bank and they told me they did not find the check in the envelope. They are saying that I did not put the check in the envelope, which I did. I was able to obtain a copy of the deposited check which clearly indicated that it was deposited into my bank.

I presented the case to the branch that I had the check deposited through their ATM and was told to wait while they investigate. What can I do? I need the money and all I have is a few bucks in my wallet and a negative bank account.


The bank is entitled to investigate, although with the documentation you provided, it should not take long, and the funds should be back in your account. When the bank restores your funds, you should also receive credit for any fees charged by the bank that may have resulted from the error, including any overdraft fees, and for any interest you did not receive on the funds while they were missing from your account.
