Spousal 'Right' to Write Checks on Spouse's Account?

My husband writes checks from our business. Only my name is on the account because he has his own account. He wrote two checks electronically for Walmart, one for $560.00 and another for $675.00. I did not tell him to write the checks; can he do this just because we are married? What can I do? We live in Texas.



You started your question by referring to "our business." Could it be that those Walmart checks your husband wrote were used to purchase business supplies or equipment? Since you didn't say, we have to ask the question.

If in fact the business is yours alone, and your husband doesn't sign on the business account, you should talk to someone at your bank about why those checks were paid with your husband's signature and not yours. Do so quickly, because your deposit contract may place a time limit on your claim that those checks were not authorized.
