On a third party check, which bank would be the one to refuse to negotiate the check...the customer's bank..or the bank that the check was drawn?
If by "customer's bank" you mean the bank that is being asked to accept the check for deposit, that's the one that is most likely to have a policy on accepting third-party checks. If that bank accepts the check for deposit, it accepts the risk that the original payee'sendorsement is unauthorized or forged.
The bank on which the check is drawn has a contract to pay properly payable checks issued by its depositors. If it pays a check with a forged or unauthorized endorsement, it is protected by warranties given by each prior holder of the check.
