No, but not every check is reviewed for the signature in today's automated processes. Banks may randomly select some checks and all checks over an internally designated amount.
Because the check was paid, you need to bring this to your bank's attention and they should reverse the fee and put the money back into your account. Now the bank will want to recover the money it just gave you. They will go to your husband, who illegally wrote a check out of your account. In a sens, he stole from you, and when the bank makes you whole, they step into your shoes, so he stole from them.
The point here is that you want to discuss this with your bank and see if they'll reverse the fee and take the money out of the account from which you had intended it to come. That request needs to be made by someone on that account to be debited, so this doesn't happen again. Perhaps this will put things the way they should have been, and the bank will waive the fee for a good customer relationship.
