Is it legal for a banker to confiscate monies from a checking account if a person is behind in car payments by one month?

Yes, in most cases your agreement allows setoff when the account is past due. Most banks provide a ten day grace period, and after that, your account is on a radar screen because it is past due. If there is money on deposit, the lender may take it to bring the account current.
