Bank Paid Items I Didn't Want Them To, Do I Owe?

I moved and forgot to make changes with regard to automatic withdrawals. There was no money in the account, but my bank thought they would pay them anyway, so I get a surprise and now wonder if I am truly responsible for the payments and any fees since it wasn't a "signed" check that was paid. Do I owe this money to the bank?


It's difficult to answer this simply. For example, a lot could have to do with whether you formally closed the account or simply drew the balance down to zero. If the bank had not closed the account, it may have expected deposits would be coming, and paid the items accordingly.

As for the payments themselves, we would imagine that you received credit with the parties that originated them, so you obtained a benefit for the payments, and you are responsible for them. Whether overdraft fees should be your responsibility may depend on whether the account was formally closed or not. You certainly can plead your case to the bank, and it may refund some or all of the fees, but quite frankly, the bank should not, in our opinion, be responsible for your mistake in not changing the automatic withdrawals.
