My son recently opened a checking account, but his direct deposit doesn't start for another week. Presently, the bank has been holding his paychecks for up to ten days. Is this legal? We live in Texas.
During the first thirty days from the opening of the account, the bank is generally permitted to hold paychecks for as long as they like, as long as they disclose their practice when the account is being opened. Once the direct deposit starts, your son should have access to his funds on the day they are received by the bank.
