Depositing a Joint Check to an Individual Account

Prior to being married I had a checking account. After I was married, I only added my hyphenated name to the account information, but did not make any other changes. A relative sent a check to my husband and me, but has addressed it to myself AND my husband... for example " PAY TO THE ORDER OF :Maggie and Will Smith. Can a check addressed in this manner be deposited into my single account or is it considered a third-party?


Before depositing this check, both you and your husband will have to endorse it, but contact your bank and explain the problem. They will be pleased to see that you realize that both endorsements are needed.

Since most banks that have problems with multiple-endorsement checks are concerned about verifying the authenticity of the non-customer signature, you should suggest to the bank that both you and your husband will be able to sign the check at the bank and provide satisfactory identification. That should go a long way toward dispelling any concerns the bank might have about accepting an unknown indorsement on the check.

In the unlikely event that your bank is unwilling to work with you on this, your only alternative would be to contact your relative, explain the problem, and ask for a check payable to you alone, or to you OR your husband. Such a check would only require one indorsement under the Uniform Commercial Code.
