Trouble with Half of Joint Account

My spouse and I share a joint checking account. However, he has been placing stop payments on checks that I write and then withdrawing the money (which he used to open a separate account). Do I have any recourse against him?


Your husband, as the joint owner of the account, does have the right to place stop payments on checks you have written, and to remove money from the account to his own account. That's one of the risks of joint account ownership.

Whether you have any recourse against your husband for taking what you may consider your funds would be something for which you'll need to contact a lawyer. In the meantime, the only way you can prevent your husband from doing this again is to close out the joint account yourself and open a new account in your own, individual name.
