Getting Money Back from an Unused Cashier's Check

I need a bank check for my house settlement. If settlement falls through, can I deposit that bank check back into my own account if it's made out to the title company? If not, can I make it out to the title company "or" myself?

The title company will want the bank check, a cashier's check, payable to them, and that is fine because if that closing doesn't happen as you plan, you can take the check back to the bank you purchased it from and ask that it be marked "not used for purpose intended" and you as the purchaser should have no problem receiving your funds back.
