When Must a Check be Cashed?

I wrote a $4,000.00 check two months ago and it has not cleared the bank. How long can the other guy keep the check before cashing it?

There is no requirement on when a check must be cashed, per se. There may be stipulations on a check such as "Valid for 60 days." or something similar. Also, many banks may refuse to pay a check after six months, considering it "stale dated." These act as incentives to cash a check because the person holding the check may have a harder time cashing it later or may have to request that it be reissued.

You may want to verify that the check was received by the person to whom you wrote it, and ask when they expect to cash it. It may have been lost.
