On a Check: Numerals vs Words

I received a check for $1040.00, but the verbiage is "One thousand and 40/100". Can I deposit this check for either amount?

When the words and digits don't agree, the words control, and the legal amount of the check is in words. In this case, the correct amount of your deposit would be $1,000.40. If the check writer made an error and you should be due the difference of $39.60, you should contact the issuer of the check.
