My cashier's check was lost in the mail a month ago. I was told to wait ninety days for a new one, but what if someone cashes it? Do I still get my money owed to me?
Assuming that you filed a claim with the bank that issued the check, the bank is correct in requiring you to wait until ninety days has elapsed, counting from the issue date of the check. If the check is presented for payment during the ninety day period by a party with the right to enforce it, in other words, the legitimate payee or someone to whom the payee transferred it, the bank would be obliged to honor it, and your claim would be denied. If, however, you make it to the nintieth day without the check being paid, once you are paid on your claim, the bank can refuse payment to anyone presenting the original check.
