I am a landlord who should have received payment from the property management company; however, the renter's payment was misrouted by the bank that represents both the property management company and the renter, so the property management company has never received the check. The bank acknowledges that the property management company never received the check. The property management company has even sent an affidavit stating that they never received the check. Now the bank says that they are “reviewing” the case. It has been three months since the misroute! Is there anything that can be legally done to speed things up?
If the property management company is responsible under its contract with you for collecting and forwarding rent payments, and if the tenant is responsible under the terms of its lease to make those rental payments to the management company, it would seem reasonable for the property management company at this point to press the tenant for a resolution. That might convince the tenant to push the bank harder to get its "review" completed.
