What to do about Lost Cashier's Check

I paid my rent by mail with a cashier's check. It has not been cashed, and my landlord claims he has not received it. How do I go about getting the money back from a lost cashier's check? How long does it take?


You can file a "Claim of lost, stolen or destroyed Cashier's Checks" with the issuing bank. The bank should have forms for the purpose. The bank will check first, to ensure that the check has not been paid.

Once the claim is filed with the bank, there is a waiting period provided for in the law (Uniform Commercial Code) of ninety days, counted from the issue date of the check. During that period, the bank is obliged to pay the original check if properly presented by a party with a legal right to do so. After ninety days, the bank can pay your claim and then refuse to honor the original check if it appears.

The bank can decide to risk having to pay twice and reimburse you before the ninety days are past. It is certainly under no obligation to do so. If it does, and the original check shows up for payment before the ninety days are over, it will have to pay the original and will have a legal right to pursue you for a refund. Accordingly, the wisest option is to wait, even if that means you have to find another way to pay the rent while you wait.
