I have a business. A customer wrote a check to my business in my business' name and signed it. I then had one of my employees take it to the bank with the account number from which it was written. He asked them to issue a cashier's check payable to the same business. Their customer would then sign the check to our business for our product. The teller said that the funds were there, but would not issue a cashier's check. Can she just decide not to give us our money? Is there not a law that would make her give me a cashier's check? She said she didnt feel comfortable doing it. Does she have a legal right to keep my money? Do I have a legal right to make her give me my cashier's check?
Whether the bank will agree to exchange a check drawn by one of its customers for a cashier's check is a matter of bank policy. The bank may legally insist that you deposit the check given to you by your customer, and wait for it to clear.
