A cashier's check was purchased and sent to a child support agency. The agency received the check, then in return, mailed me my support. As of now, which has been twelve days, I still have not received it, and it has not been cashed according the the child support agency. Is it possible to cancel that check and then get another without a ninety day waiting period?
The check issued by the child support agency is missing, not the cashier's check that it received. If that's correct, we don't understand the ninety day waiting period unless it's a policy of the child support agency that applies to checks it has issued. If all of that is true, it seems that the agency would have to waive its policy to replace the check before the ninety days is up.
If the cashier's check was payable to you and merely sent to the agency, and the agency forwarded the cashier's check to you, you as payee can file a claim with the issuing bank that the check is lost. The bank does not have to honor the claim until the end of the ninety day period starting on the date the check was issued. It may do so, but that exposes the bank to the risk of having to pay the original check if it is presented for payment. Most banks that don't wait the ninety days require some form of surety or guarantee of repayment to offset that risk, and that surety may be quite expensive, if you can find a bonding company or insuror willing to provide such a surety.
