I mailed a check to a business to pay for copying a set of records. The check was apparently stolen by one of the company's employees and cashed somewhere. When I got online to look at a copy of the check there was no endorsement or bank stamp on the back and there weren't any changes made to the front. Is my bank liable to refund my money for paying this unendorsed check?
If the payee of the check actually did not receive credit for the check, you should ask the business to provide you an affidavit to that effect. Then you can use the affidavit to ask your bank for a refund, and your bank can enter a claim against the bank that took the check for deposit. Of course, you still owe the business for the copies, and they have a right to expect to be paid.
