My mother is the executrix of my grandparents' estate. We received a due diligence notice on two checks that were issued, but never cashed. We provided all of the documentation and had the checks reissued. The bank would not accept the checks into the estate account. They were made out to my grandparents, care of my mother. The issuing company said that they can only reissue the checks the same as they were originally. How do we resolve this issue?
Your mother can ask the bank to accept the checks for collection and to credit the account only after they are paid. She will be asked by the bank to endorse the checks as executrix of the estate of the payee. The bank is understandably concerned that a check issued to a deceased individual after the date of death might be dishonored.
