My check from the bank never arrived, but was cashed somewhere. Who's responsible and what should I do?
Contact the issuing bank and explain the problem. The bank can provide you a form for an affidavit that you'll need to complete. Depending on the type of check you're writing about, you may be able to get a quick replacement for the check, or may have to wait 90 days from the old check's date of issue.
The issuing bank may be able to recover its funds by filing a claim with any other bank that took the check for deposit or cashed it. Ultimately, the law in such cases is designed to place financial responsibility with whoever took the check from the dishonest individual who cashed it.
