When a check is payable to "stacked names" (one above the other with no wording like "and" or "∓") as payees, the check is payable to either payee, and either can negotiate it, but your bank could require an endorsement from both you and the representative of your brother's estate, the administrator or executor, as a condition of accepting it for deposit.
