Separated: How to Cash a Check

My husband got a last payroll check from work and he and I are no longer together, but the check came to my address and we still are legally married with the same last name. How could I cash the check?


If the check is payable to your husband, you will need his endorsement before you can cash it. If you attempt to cash it without his endorsement, you could find yourself in legal trouble for theft and/or forgery.

If your husband owes you money, for child support, for example, you'll still need to obtain his endorsement before attempting to cash the check. In fact, banks are more and more reluctant to cash checks for a third party (someone to whom a check has been transferred), so you might run into problems even if you do convince your husband to sign the check over to you.
