If I deposit a suspect check, how long do I have to wait to make sure it clears, and make sure the bank can never come back on me for the money? Is there a time line, that if you wait, that the bank can not say I owe them the money?
Under U.S. and state laws, if the check is dishonored and returned, you'd be liable regardless of how long it took, with an outside legal limit of three years. Under certain circumstances, that could be cut way back to 30 days.
If the check is presented to the bank it's drawn on and not dishonored by that bank by midnight of the next business day, that bank would not be legally able to return the check except for a warranty claim (forged endorsement, alteration, etc.). If you suspect that a check might not be good, the best way to ensure you won't get hit with a charge back is to have your bank submit the check for collection. If your bank is paid, the payment will be final. If the check is dishonored, you won't have spent the money.
