Can my husband deposit a check into his account that is made out to me, even though my name is not on his account? Would I need to sign something to give him permission to do this?
It would be legal for your husband to deposit the check to his account if you had first endorsed it and given it to him. It would also be legal if you had given your husband a power of attorney to endorse and deposit checks payable to you to his account. If your husband simply takes an unendorsed check payable to you, forges your endorsement and deposits the check to his account, his actions are probably not lawful unless you receive the benefit of the funds.
