My husband and I are divorced. Because we divorced in 2007, our tax return that year was filed in both our names. We intially had the tax return scheduled to be made via direct deposit/electronic deposit, but it took so long to get that set up, by the time it was sent we had closed our joint account. My now ex-husband does not want any of the return, as I was the only one who had income that year. Also, he is receiving disability and cannot have income.
My problem is that the treasury check is written to both of us. My bank would not let me deposit it, so I mailed it to him and he signed it and added his ID number and I wrote "For Deposit Only" on it. The bank still refused to deposit it, so I got a notarized letter from him stating that he has instructed me to deposit this check in my individual account, with contact information for the bank. They say they need a Medallion Signature Guarantee, which they claim they don't provide. Our biggest problem is he lives in Canada, I live in the USA, 3000 miles apart. What can I do under the law?
We don't know if any Canadian banks participate in the Medallion Signature Guarantee program or not. Call and ask them. There is no publicly available list of participating banks.
The next process is for you to call your banks and other local banks and ask them if they participate. Then ask what they would need to verify that check, and if they can't do anything without him, what could be done with his attorney, a special power of attorney for just this, or a Canadian equivalent to the Medallion.
