Bank Won't Cash Check Without an EIN

My husband passed away in July. I received a payment from his long term care company for services rendered during his illness. My bank will not accept it without an EIN, even though I am the sole beneficiary and executrix of his estate. Where can I deposit this check without all of this nonsense? I live in West Palm Beach, Florida.


Assuming that the check is payable either to your late husband or to his estate, the estate's representative must endorse it. It appears that the bank is expecting you to open an account for the estate and deposit the check there. If that is the case, the bank would correctly require that you obtain a separate taxpayer ID number in the form of an EIN, for the estate. You would have to have an official court appointment as executrix for any of that to happen.

Your bank might be willing to have you as executrix endorse the check to yourself and then deposit it to your personal account, if they are assured that you are the only party with an interest in the estate. Even under those circumstances, however, the bank could ask that you provide documentation from the court that you have been appointed as executrix; the designation in a will is not sufficient documentation.
