A customer wrote us a check for some water damage work on her carpet in the basement of her home. We made the first trip and wet-vacced. We were scheduled to return the next day and finish the job. When we called to inform the customer that we were heading her way, she said she changed her mind, so we went there, got our fans and charged her $75. She wrote the check, then stopped payment on it. What can I do?
Consult an attorney or small claims court. You can also ask your district attorney if this may be considered "theft by check" in your area, and if there are any remedies.
When a customer tells the bank to stop payment, the bank has no real options if the check is still outstanding. It doesn't matter what the reason for the stop request is. The bank simply has to do it. They won't, and shouldn't get involved in any dispute.
