I lost my paycheck, which I had already endorsed. It was cashed by someone. My employer said the bank is not willing to accept a claim or affidavit form for him, so he cannot get the money back. He refuses to give me another check. Is there anything I can do?
When you endorsed that paycheck before getting to the bank or other place where you intended to cash or deposit it, you pretty much foreclosed any possibility of issuing an affidavit of forged endorsement. It will be nearly impossible to successfully claim that payment of the check was improper or that your employer didn't pay you. The lesson: never endorse your paycheck until you have arrived at the bank.
