I deposited a Wachovia Financial check in my Bank of America account on February 4, 2009. When I went online on February 25, I saw that the check for $132.50 was being returned NSF to me. Can a bank wait thirteen business days to return a NSF check? I thought the maximum was nine business days.
Once a check reaches the bank it is drawn on, that bank has until midnight of the next business day to either pay the check or return it unpaid. Thirteen business days is much longer than it should take for that check to be returned.
Check with your bank and ask them to review the dates to see if the paying bank made a late return. If it did, you may be entitled to recover your funds and the paying bank will be required to absorb the loss or find a way to recover it from its own customer.
