I had a check signed over to me by my cousin over a year ago. Now my cousin called and said he needed a copy of that check. I called my bank to get a copy of it and they said that the check is now invalid, and they are going to be sending the funds back to the original bank because the check was not in my name. They took the funds from my checking account that I do not use anymore. Now my balance is -90. Everyday there will be another $30 fee. What are my rights?
If the check was endorsed over to you by your cousin, it is strange that the bank is now making this claim. Ask if they need anything else from your cousin as evidence that it was meant to be payable to you. It may be that the check wasn't signed over to you as it should have been, and there could be a claim that your cousin claims they didn't receive any benefit of the check. A discussion with your bank and your cousin, together, may be in order.
