I had a home business in 2007, giving in-home parties. I accepted a personal check for $217.53. It was returned NSF. I went to the bank every month for six months, but there was never enough money to cover it. It is nearly two years old. Is it still valid?
If the bank account on which the check is drawn is still open, it can refuse payment because more than six months have passed since it was issued, or pay the check if there is no stop payment on it. However, if the check was given to you for services or goods delivered, your right to be paid hasn't been wiped out.
If you want to be paid, you probably can't rely on the check except as evidence of the claim for payment. Retrieve whatever other documentation you have of the transaction behind the check and contact the purchaser directly for payment. If the purchaser refuses to pay, take a look at your county's Court of Small Claims as a relatively inexpensive way you may be able to bring legal action to collect the funds.
