Banks Returns Check to IRS, Not Me, Why?

I deposited a joint federal income tax refund check for my husband and I into my account, which does not have my husband's name on it, through the ATM we both signed. Apparently you cannot do this. The bank said that they are sending check back to the IRS, not us. Is that legal? The IRS is saying it could be a month until check is reissued.


To send the check to the IRS rather than back to its depositor is simply wrong! There's nothing you can do about it at this point other than wait for the IRS to reissue the check, but when it arrives, do yourselves a big favor, and don't endorse it until you make very sure your bank will accept it for deposit. The bank may not be willing to accept it for deposit to your individual account unless your husband endorses it at the teller window and provides ID. In fact, they may not be willing to accept it at all, in which case you may want to consider adding him to the account or making other arrangements.
