I had a return deposit for over $9000.00 from over a year ago for a missing endorsement. The bank put a ten day hold on the check when I deposited it then. The bank would not release the check to me for the missing endorsement. After five days, I told them they did not have the legal right to do this. The person checked and agreed with me, and released a substitute check. I gave check to my attorney to send to get the missing endorsement. Now the check has been lost by the other company. I have a negative balance and I am having to pay late fees on all bills and NSF charges for checks I wrote. The bank is agreeing to meet with me. What legal action can I take?
Talk to your attorney. The issuer of the check or its bank is sitting on your money at the moment. Your attorney may be able to convince the issuer that the check is now lost and they can issue a replacement. If they do that, be certain to get the endorsement of the second payee before you deposit it.
