I cashed a cashier's check and six months later it was returned for the reason of unable to locate an account. It was a counterfeit, and the name on the check and the bank they sent it to didn't match. My bank is now telling me I can't file a late return claim and is holding me accountable. Is that allowed?
It's impossible for us to answer without knowing the route the check took when it left your bank, when it got to the bank on which it was purportedly drawn, and when it started its journey back to your bank. We do agree, however, that at first blush the six-month period seems to strongly suggest that someone sat on the check too long. Without knowing who or why, we can't say whether your bank should assert a late-return claim.
