Responsibility for Stop Payment Fee

Who is responsible for a stop payment fee? My former landlord sent me a check for my security deposit which I did not receive. When he reissued the check, he issued it for $30 less to cover his stop payment fee for the previous check. When I moved out of the house, I provided him with my new address and did a change of address with a post office in a timely manner. As far as I know, whoever has sent the check is responsible for the stop payment fee.


The responsibility for the stop payment might be discussed in your lease contract. Otherwise, unless there's an agreement to the contrary, the stop fee would probably be the responsibility of the party that wrote the check. The fee could be seen as your responsibility if you had received the check and lost it, or if you had failed to provide a forwarding address. If your landlord is not forthcoming with the $30, it may not be worth your time, trouble or expenses to try to collect it.
