I received a check from my cell phone company. It was stolen from me and cashed. The cell phone company is telling me to contact the bank that cashed the check and that bank is telling me to contact the cell phone carrier's bank. Which bank is responsible to get me my money back?
Neither one, it is the cell phone company's responsibility to send you a replacement check, but first, it should work with you to obtain an affidavit that your signature in the endorsement of the original check was forged and that you received no part of the proceeds of that check. The cell phone company then files a claim with its bank for paying the original check in error. That bank files a claim with the bank that cashed the check. It may take some time, but this is the way you get your money back.
