I deposited a state check without my husband's signature or mine. The check was in his name, and the banker just stamped it. What will happen if that check comes back to the bank?
It's perfectly acceptable for a bank to accept checks for deposit without endorsement, provided that the checks are payable to the owners of the account involved, so if your husband is an owner or joint owner of the deposit account that received the deposit, there should be no problem. The could be a problem, however, if the check was deposited to an account in your name only and your husband later files a claim with the state that he didn't endorse the check and didn't get any benefit from it. In that case, the state would start a claim process that could end with your bank charging the check back to your account. That shouldn't happen if you and your husband are on good terms and your husband doesn't have any reason to object to your deposit of the check.
