Cashing a Check with Two Payees

I received a check made payable to first party "and" second party as joint tenants. The parties have different names. Can either party deposit it into a bank account that does not list both names? Can this check be cashed without both signatures?


Checks drawn payable to the order of two persons with the word "and" or an ampersand ("&") between them must be deposited to an account jointly owned by the two named persons or endorsed by both persons prior to negotiation (depositing, cashing, or transfer to another party).
