My ex and I had to redo our 2008 state and federal taxes and ended up getting a refund. The refund for both of us was sent as a paper check in both our names, since it was filed jointly. He already got the state refund check and cashed it without me signing it or being present. Is this legal and can he do it with the federal refund as well?
Your endorsement is required. You are (depending on state laws or other agreements) entitled to one-half of the money. If you feel that is the case and the funds were stolen, you have a few choices. Tell your ex you want your half; tell the government agency that issued the check that your signature wasn't on the check and you want your money, or do nothing.
In the case of making a claim, the government agency goes to the bank and takes back the money. The bank takes it from your ex's account or tells him he has to repay it immediately. Other actions depend on whether he forged your signature.
