Do I have any rights when someone has given me a bad check and the bank takes all the funds from my account?


Yes, you do. You have the right to attempt to collect from the party that gave you the bad check. In some cases, you can file a complaint with the police and hope that a criminal prosecution will follow.

If the return of the check to your bank was timely, your bank had the right to charge the check back to your account, even if you had already spent the funds. If an overdraft is created, your bank will have the right to require you to deposit funds to cover the overdraft.
