I deposited 20 checks totaling $3,000. The next day the bank said that they only found $500 and took $2,500 out of my account. I complained and they did a trace and found another $700, but I'm still out $1,800. I have proof that the bank received the full $3,000, but the bank won't budge because they can't find the other checks. How should I go about resolving this issue? Can I sue the bank for the lost $1,800?
The bank's controls appear to be a problem, if they misplaced $700. That adds credibility to your claim that there's another $1,800 floating around somewhere.
If you know which checks are still lost, try to contact the people who gave them to you, and ask them to find out if their checks have been negotiated and paid. Once the checks have been paid, the route they took and the accounts into which they were credited should be identifiable with some research.
If the checks are not presented and paid, it's likely they have been separated from your deposit at your bank, and are lying around somewhere in the bank's check processing areas. A lawsuit would probably serve no purpose. If the checks are actually lost, a suit will just cost you legal fees and probably won't produce an adjustment from the bank.
