Cashing Pay and 401k Checks for Deceased Payee

My son recently passed away and I have his last paycheck and his check from his 401k that was issued in care of me. My bank does not allow third-party check cashing. How do I cash these checks?


Those checks are part of your son's estate. They can legally be negotiated only by the legal representative of his estate. If your son did not leave a will, someone will have to work with the probate court to have an administrator appointed so that these checks can be negotiated and any money in bank accounts, etc., can be distributed to your son's heirs or next of kin. That process may be easier if there was a will left.
