My mother-in-law submitted an application for a rent rebate from the state of Pennsylvania prior to her death. She designated my husband as the beneficiary on the application and we notified the state of her death, but they sent my husband a check that was made out to his mother and there is no estate. Can our bank cash this check since he is the beneficiary?
Probably not. The check doesn't indicate who the beneficiary is, and the bank has to confine itself to what it sees on the check.
As it is drawn, the check is payable to your mother-in-law's estate, and could only be negotiated by a representative of the estate. Contact the appropriate Pennsylvania state agency to arrange for a re-issuance of the check.
