Depositing an Incorrectly Endorsed Check

I recently received a cashier's check for a boat that I sold. However, the person who wrote the check forgot to include my last name on the check. Can I still deposit the check into my bank?


Your bank may or may not be willing to accept the check for deposit. If they are willing to do so, it will be because they are convinced that you are the individual that the check should be payable to. If they accept the check for deposit, you should endorse it as it is drawn, and then with your correct legal name. For example, if your name is Carl James Smith, and the check is payable to Carl James, endorse the check first as Carl James, and then endorse it as Carl James Smith or Carl J. Smith, if that is how your bank knows you.

If your bank won't accept the check for deposit, you may need to contact the person who sent you the check and ask him or her to go with you to the issuing bank to have the check re-issued. If you're still holding the title on the boat, that shouldn't be too hard to do. If you've already surrendered the boat and title, you'll have less leverage to get that done.
