Joint Check Deposited into Single Account: Legal?

My soon to be ex-husband had our state tax relief check direct deposited into his personal account. The tax relief was made out to both of us. Is this legal? We reside in New Jersey and don't have a joint account together. What should I do?


Even the IRS will permit direct deposit of a joint refund payment to one of the spouse's individual account. It specifically says so in its instructions for signing up for direct deposit. Most states adopt that model. They consider the allocation of the funds to be a private matter between spouses.

Assuming that the property owners have to file a request for the payment and for direct deposit, it's usually the case that the form has to be signed by both parties. That would require that you agree.
